General terms and conditions of business
As a social media marketing agency, Galaxy Marketing offers services with the goal of increasing the number of followers, likes & comments of our clients’ social media profiles.
§ 1 scope of application
The following General Terms and Conditions regulate the contractual relationship between Galaxy Marketing (hereinafter referred to as “Provider”) and customers who commission the services of Galaxy Marketing (hereinafter referred to as “Customer”).
§ 2 Subject matter of the contract
Subject of the contract is the mediation of followers, likes, comments and views, subscribers, likes and similar on social networks such as YouTube, Instagram, Facebook & Twitter. The characteristics of the individual services can be found in the respective offers on our website.
§ 3 Conclusion of contract
The offers at GM do not yet constitute a binding offer to conclude a contract, but rather an invitation to the customer to place an order. The contract comes into effect upon confirmation by the provider or at the latest upon execution of the contract by the provider. The individual technical steps leading to the conclusion of the contract are as follows: To submit an offer, the customer first selects the respective social network, the number of desired followers, comments, etc. He enters the target URL and clicks the button “add to shopping cart”. Before he sends his order, he will receive an overview of the data of his order. Here he has the possibility to check his order for input errors and to correct them by using the back function of his internet browser.
§ 4 Contract language, storage of the contract text
Contract language is German. Apart from these General Terms and Conditions of Business, the text of the contract, in particular concerning individual orders, is not stored.
§ 5 Terms of payment
As means of payment the payment service PayPal and Sofortüberweisung as well as Paymentwall are available. With the PayPal Plus payment service, payment by direct debit or credit card is possible. We also offer credit card processing through CommerceGate: Our Payments Facilitator and Billing Support.
§ 6 Delivery time
The service is provided online depending on the number of ordered followers, comments and the respective social network within approx. 1 – 7 days – in individual cases in up to 40 days – after receipt of payment by the provider.
§ 7 Legal liability for defects, customer service
There is a legal right of liability for defects for the services offered (mediation of Instagram Follower or Likes and similar in the number stated in the offer text). This depends on §§ 634 ff. BGB and the regulations of the BGB referred to there.
§ 8 Dispute settlement
The European Commission provides a platform for the extrajudicial online settlement of disputes (so-called OS platform) at http://ec.europa.eu/consumers/odr/. The provider is neither obliged nor prepared to participate in dispute resolution proceedings before a consumer arbitration board.

§ 9 Provision of the service

In order to be able to offer the widest possible range of services, the provider cooperates with several partner networks abroad, which have to provide the customer with the service ordered. The customer acknowledges that it cannot be guaranteed to receive the exact quantity of the respective service ordered. Galaxy Marketing always tries to deliver more than actually ordered, as there can often be reductions during and after delivery. In rare cases, the delivered quantity may differ significantly from the ordered number of views, likes, followers & comments. The customer acknowledges that in such cases it is not possible to cancel or remove the service provided. A (partial) refund is only guaranteed if we are not able to provide the service in full.
As a rule, proof of delivery can only be provided by means of the meter reading, which is recorded by screenshots. Galaxy Marketing has no influence whatsoever on accompanying phenomena such as additional comments, likes or messages that are not a direct result of the service.

Unless otherwise stated, all services are international profiles. They are not a representation of the world population, but in extreme cases may originate completely from a single country. We cannot guarantee that there are no inactive users among the mediated profiles.

§ 10 Final provisions
For customers who are merchants within the meaning of the German Commercial Code (HGB), the place of jurisdiction for all disputes arising from the contractual relationship with the provider is the provider’s place of business. German law applies to the contractual relationship. If the contractual partner is a consumer, legal regulations of the country of residence of the contractual partner for the protection of consumers remain unaffected. The UN Convention on Contracts for the International Sale of Goods shall not apply.
